Terms of Service & End User License Agreement (EULA)
Standard licensing agreement, terms of use, and governing law aligned with the Atlassian Marketplace End User Agreement (EULA v1 / Bonterms Standard).
By installing, subscribing to, or accessing Mind Map Studio via the Atlassian Marketplace, you and your organization agree to these Terms of Service with getCodeLess OÜ ("Provider"). These terms operate in harmony with your Atlassian Marketplace Order and the Atlassian Marketplace End User Agreement.
1. Scope & Atlassian Marketplace Framework
This Agreement governs your subscription, installation, and use of Mind Map Studio for Jira & Confluence. Mind Map Studio is licensed, not sold, through the Atlassian Marketplace. Where you purchase an active subscription via Atlassian Marketplace, the financial terms, tier limits, seat counts, and payment schedules specified in your Atlassian Order Form apply. In the event of any conflict between this Agreement and the Atlassian Marketplace End User Agreement (EULA v1), this Agreement shall govern the specific operation and technical terms of Mind Map Studio.
2. Grant of License & Permitted Cloud Usage
Subject to the terms of this Agreement and your active Marketplace subscription, getCodeLess grants you a non-exclusive, non-transferable, non-sublicensable, revocable, worldwide license to install, access, and use Mind Map Studio strictly within your authorized Atlassian Cloud organization instances. Usage is authorized solely for your internal business operations and for the number of user seats provisioned through your Jira / Confluence licensing tier.
3. Customer Data Ownership & Data Protection
You retain sole and exclusive ownership of, and all intellectual property rights in, all data, text, diagrams, Jira issue content, sprint structures, and metadata that you create, input, or sync within Mind Map Studio ("Customer Data"). getCodeLess does not claim any ownership rights in Customer Data. Mind Map Studio accesses Customer Data strictly on-demand to render canvas visualizations, create/link Jira tickets, and execute user-initiated commands pursuant to strict Atlassian asUser() permission tokens.
4. Zero External Data Egress & Forge Security Sandbox
Mind Map Studio is engineered 100% natively on Atlassian Forge and executes entirely within Atlassian Cloud isolated compute environments. All visual graph structures, node coordinates, custom theme presets, and folder hierarchies are stored solely within the Atlassian Forge Key-Value Storage (KVS) within your tenant. getCodeLess does not maintain external database servers, does not egress Customer Data to external clouds, and does not sell or share customer metadata with any third party.
5. Acceptable Use & Usage Restrictions
You agree not to: (a) reverse engineer, decompile, disassemble, or attempt to derive the source code of the application; (b) bypass, probe, or circumvent any security controls, Forge permission gates, or rate-limiting mechanisms; (c) use the application to store, process, or transmit illegal, infringing, or malicious content; (d) resell, lease, sublicense, or distribute the application to unauthorized third parties; or (e) utilize the software in ultra-hazardous environments where failure could lead to personal injury or severe physical damage.
6. Free Tiers, Evaluation Trials & Beta Features
If you access Mind Map Studio under a free Atlassian Marketplace evaluation trial (typically 30 days) or test experimental preview features designated as "Beta" or "Coming Soon", your use is permitted solely for internal evaluation purposes. getCodeLess provides trial and beta versions strictly on an "AS IS" and "AS AVAILABLE" basis without any warranty, SLA uptime commitments, or indemnity obligations. Aggregate liability for trial and beta usage is expressly capped at US$1,000 (or equivalent local currency).
7. Technical Support & Service Level Agreement (SLA)
getCodeLess provides technical support, incident resolution, and maintenance updates for active commercial subscriptions via its official support portal and email desk (support@getcodeless.tech). The application is maintained under our published 99.9% Cloud Uptime SLA. Scheduled maintenance, emergency security patches, and platform dependency updates are coordinated without retroactive decrease in core functionality.
8. Warranties & Express Disclaimers
getCodeLess warrants that Mind Map Studio will operate substantially in conformance with the published documentation during your active subscription term. EXCEPT FOR THE EXPRESS WARRANTIES SET FORTH HEREIN, MIND MAP STUDIO IS PROVIDED "AS IS". TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GETCODELESS EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
9. Platform Dependency on Atlassian Cloud Infrastructure
Customer acknowledges and agrees that Mind Map Studio is an Atlassian Forge-native application that relies directly on the underlying availability, infrastructure, network latency, APIs, and hosting of Atlassian Cloud. getCodeLess is not responsible or liable for any performance degradation, rate limiting, outages, or platform changes originating from Atlassian Cloud or customer network failures beyond our reasonable control.
10. Intellectual Property Rights & Feedback
getCodeLess and its licensors retain all right, title, and interest (including all copyright, patent, trade secret, and other proprietary rights) in and to Mind Map Studio, including its canvas rendering engines, custom layout algorithms, and theme palettes. If you provide suggestions, feedback, or feature requests, getCodeLess may use and incorporate such feedback freely without restriction or compensation. "Atlassian", "Jira", "Confluence", and "Forge" are registered trademarks of Atlassian Pty Ltd.
11. Confidentiality & Data Processing (DPA / GDPR)
Each party agrees to protect the confidential information of the other with the same degree of care it uses for its own sensitive data (at least reasonable care). getCodeLess processes data in strict compliance with the European Union General Data Protection Regulation (GDPR). Our Data Processing Addendum (DPA) and Privacy Policy govern all data handling, and automated 7-day Atlassian deletion hooks ensure permanent erasure upon uninstallation.
12. Mutual Indemnification
getCodeLess will defend Customer against any third-party claim alleging that Mind Map Studio infringes a valid patent, copyright, or trademark, and will indemnify Customer against damages final-awarded by a court of competent jurisdiction or agreed in settlement, provided Customer promptly notifies getCodeLess and tenders defense control. Customer will defend and indemnify getCodeLess against claims arising from Customer Data violating third-party privacy or intellectual property rights.
13. Limitation of Liability & Consequential Damages Waiver
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) IN NO EVENT SHALL EITHER PARTY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS REPUTATION, REGARDLESS OF THE THEORY OF LIABILITY; AND (B) EACH PARTY'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THIS AGREEMENT SHALL BE STRICTLY LIMITED TO THE TOTAL SUBSCRIPTION FEES ACTUALLY PAID TO GETCODELESS FOR MIND MAP STUDIO IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY.
14. Term, Termination, Export Compliance & Governing Law
This Agreement remains in effect for the duration of your Marketplace subscription. Either party may terminate for material breach with thirty (30) days written cure notice. Both parties represent that they comply with all applicable EU and US export control and sanctions laws. This Agreement is governed by the laws of the Republic of Estonia and the European Union, without regard to conflict of law principles. Any dispute shall be settled before the competent courts of Tallinn, Estonia.
